Kenneth D. McPherson III
Attorney with Gibbons LawMr. McPherson is an attorney with Gibbons Law and concentrates his practice in the areas of regulatory affairs, land use, redevelopment, affordable housing, environmental contamination, and related litigation. Utilizing his previous experience as both a former member of and then counsel to the Township of West Orange Planning Board, he provides unique guidance on applications to local government entities in connection with site plan approvals, subdivisions, variances, and rezoning applications. Mr. McPherson regularly represents developers of industrial, commercial, and residential projects throughout the state of New Jersey as part of the land use and redevelopment process. He also advises clients in transactional matters, including acquisitions and dispositions, financing, joint ventures, and leasing. In addition, Mr. McPherson has experience litigating a wide range of employment, premises liability, and insurance coverage disputes in both state and federal courts. He previously served as Chief of Staff & Legislative Counsel to New Jersey State Assemblyman Raj Mukherji (LD-33). In those capacities, he analyzed the legal sufficiency of proposed legislation, oversaw day-to-day operations of the legislative district office in Jersey City, and served as the Assemblyman’s chief advisor and communications director.

Associate Director of Hydrology and; Hydraulics Services Taylor Wiseman and TaylorMr. Smith is the associate director of hydrology & hydraulics at Taylor Wiseman & Taylor. He is a Civil engineer with over 40 years of experience with water resources projects. Areas of specialty include hydrology and hydrologic modeling, floodplain construction permitting, FEMA’s National Flood Insurance Program, dam safety, flooding and flood-related issues.
William C. Sullivan, Jr.
Chair of Scarinci Hollenbeck’s Environmental GroupMr. Sullivan, concentrates his practice in the areas of environmental law, land use law, redevelopment law, and renewable energy law. His practice includes the representation of clients with respect to a wide variety of land use and redevelopment projects, energy infrastructure projects, environmental permitting and compliance, site remediation, and related litigation. Mr. Sullivan has represented private developers on significant development and redevelopment projects throughout northern New Jersey, in communities such as Hackensack, Ridgefield, Teterboro, Woodland Park, Harrison, Kearny, Linden, Newark and the Oranges. For example, he served as the primary permitting counsel for a $1 billion regional, private energy transmission project in Bergen and Hudson Counties, and he served as the land use and permitting counsel for the John Theurer Cancer Center at Hackensack University Medical Center. Mr. Sullivan also has a specialized expertise related to projects subject to the land use permitting jurisdiction of the New Jersey Sports and Exposition Authority (formerly the New Jersey Meadowlands Commission), which controls the development of property in all or portions of fourteen municipalities in the Meadowlands region, using legal criteria distinct from any other municipalities in the State. He has obtained approvals for multiple commercial and industrial projects in this region.
Mr. Sullivan also represents public clients in land use regulatory matters, including the City of Elizabeth Zoning Board of Adjustment, the Township of South Orange Village Planning Board, and the Township of Bloomfield Historic Preservation Commission. He has represented clients in regard to energy efficiency and renewable energy projects, including advice on financial incentives, contracting for efficiency and renewable projects, and regulatory approvals related to these projects. His litigation experience includes cases related to land use development, contaminated site remediation and environmental and commercial insurance coverage disputes.
Dennis M. Toft
Chair, Environmental Law at Chiesa Shahinian and Giantomasi PCMr. Toft is a renowned environmental lawyer who applies a keen understanding of science and the complexities of regulatory process when addressing the wide range of issues that his clients face. He provides counsel on all aspects of environmental law, including regulatory counseling, environmental due diligence, permitting, enforcement and environmental litigation, development/redevelopment and environmental insurance. Mr. Toft is highly regarded as one of New Jersey’s leading Brownfields redevelopment practitioners. Governor Christine Todd Whitman appointed him to serve on the New Jersey Brownfields and Contaminated Site Remediation Task Force, a group created by state law to identify and market Brownfields sites. In 2002, Governor James McGreevey appointed Mr. Toft as chairman of the task force. He was a member of Governor Chris Christie’s transition team, where he was a member of the Environmental Protection Committee. Mr. Toft was also appointed by Governor Richard Codey and served on the New Jersey Solid Waste Advisory Council. He was also a member of Governor McGreevey’s Transition Team – Environmental Committee. Mr. Toft regularly appears before the New Jersey Department of Environmental Protection, the Army Corps of Engineers, the U.S. Environmental Protection Agency, municipal land use boards and the Office of Administrative Law, and in state and federal courts. He has extensive experience representing clients in numerous complicated transactions in litigation and in regulatory matters. Typical matters include assisting a client in negotiating the first environmental risk transfer agreement that was approved by the New Jersey Department of Environmental Protection; representing clients in obtaining all the regulatory approvals for major facilities, utility lines, hazardous and solid waste incinerators and similar controversial projects; defending and negotiating settlements of natural resource damage claims; defending clients in cost recovery actions; defending and negotiating settlements of civil and criminal enforcement actions resulting from discharges or permit violations; representing clients dealing with Clean Air Act, Water Pollution Control, RCRA and other complicated regulatory processes; and handling all aspects of complicated Brownfield transactions. Mr. Toft played a key role in the adoption of the New Jersey Brownfields and Contaminated Site Remediation Act. More recently, he was instrumental in the development and adoption of the New Jersey Site Remediation Reform Act (SRRA), which establishes a Licensed Site Remediation Professional Program in New Jersey. Mr. Toft received his J.D. degree from Columbia Law School, where he was a Harlan Fiske Stone Scholar and served as a staff member and administrative editor of the Columbia Journal of Law and Social Problems. He earned a degree in physics from Massachusetts Institute of Technology, where he was elected to Sigma Xi, the Scientific Research Society.

Course Description: This 5.5-hour course explains the requirements of the New Jersey Flood Hazard Area Control Act for design professionals and those involved in the development process and explores compliance methods and strategies. The course will discuss the dangers of flood events, demonstrate how to determine flood hazard areas, discusses permitting and authorization and explains how to obtain general and individual permits and how to participate in the permitting process.
