Course Title: Property Rights in Practice: Navigating Easements, Takings and Eminent Domain
Delivery Method: Live Online
Course Description: This two-hour course examines the constitutional and legal foundations of private property rights, with emphasis on easements, eminent domain, and regulatory takings. Instruction covers Fifth Amendment protections, the condemnation process, just compensation and valuation, and the frameworks used to identify and respond to potential property rights issues in planning, design, and legal practice.
Learning Objectives:
Learning Objective 1: Learners will be able to explain how Fifth Amendment takings clause protections and limits on governmental authority safeguard private property owners from uncompensated loss when public infrastructure and development projects affect their land.
Learning Objective 2: Learners will be able to identify when easements, rights-of-way, and property restrictions may deprive owners of the beneficial use of their property in ways that entitle them to just compensation under the law.
Learning Objective 3: Learners will be able to evaluate the impacts of partial and total takings on affected property owners and communities, including the determination of just compensation and severance damages that protect owners from bearing a disproportionate public burden.
Learning Objective 4: Learners will be able to recognize when land-use regulations, exactions, and permit conditions cross the constitutional threshold into a regulatory taking, ensuring that the costs of public benefit are not unfairly imposed on individual property owners without compensation.
